Commercial Electronic Message Consent

Under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages.
This English text is provided so that the document can be read by people who do not read Turkish, including App Store reviewers. The Turkish original is the version that governs; in the event of any discrepancy, the Turkish text prevails.
This text is presented as a document separate from and independent of the Explicit Consent text. The reason is this: consent to commercial electronic messages is governed not by the Personal Data Protection Law but by Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, and the consent record must be entered into the Ministry of Trade's Message Management System (İYS). The consent may therefore be collected on the same screen as consent under the data protection legislation, but its legal source and its storage and record-keeping obligations are different.

2. Scope
If you give your consent, the 28 app may send you commercial messages (campaigns, announcements, recommendations, discounts, new feature promotions) through the following channels:
- SMS / text message
- In-app push notifications for marketing purposes (those falling outside functional or mandatory notifications)
Notifications belonging to the App's core function, such as "tonight is live" and "you're in", are not commercial electronic messages; they continue to be sent independently of this consent. For as long as your account is active, notifications of that kind are part of how the App works; you can turn notification permissions off entirely from your device settings.
3. The consent statement
Under Article 7/1 of the Regulation, the consent must contain a positive declaration of intent by the recipient that they accept the sending of commercial electronic messages, their name and surname, and their electronic contact address.
When you give this consent, your communication preference is recorded in İYS within three business days under Article 7/11 of the Regulation. İYS is the official system in which consents collected by sending companies are centrally verified and in which recipients can see and manage their own consents in one place. Commercial electronic messages may not be sent to recipients who have no consent recorded in İYS.
4. Withdrawing consent (right to opt out)
You may withdraw your consent at any time, without giving any reason and free of charge. You can opt out in the following ways:
- From the in-app "Settings → Notifications → Marketing Messages" section
- Through the "STOP" or "unsubscribe" link in every SMS or email sent to you
- Through a brand-level opt-out in İYS (iys.org.tr)
Under Article 10 of the Regulation, your opt-out request is actioned within three business days of reaching the service provider, and no commercial electronic message is sent to you after that period. The opt-out is also notified to İYS within three business days (Art. 9/6).
5. Storage of consent and message records
Under Article 13/2 of the Regulation:
- Consent records are kept for three years from the date the consent ceases to be valid.
- Other records relating to commercial electronic messages are kept for three years from the date of record.
- The burden of proving the existence of consents obtained outside İYS falls on the service provider. For that reason the date and time the consent was obtained, the channel, the IP address and the version of the consent text are recorded.
Under this consent your contact details (phone number and/or email address) are processed only for the purpose stated above and for as long as the legislation requires.
